Rental agreement

This document represents the binding contract between the client named in the Client Details section of this documents, hereafter named ‘the client’, and Estepona Services, represented by its owner, hereafter named ‘the owner’.
The owner and the client agree to a short-term holiday let of the following property:

The property is shown in detail on the website of the owner and all the photographs shown on the website correspond to the said property.

1 The rental period agreed between the client and the owner begins on the arrival day 00-00-00 and ends on the departure day 00-00-00.

2 The client can occupy the property at 16:00 hours on the arrival day and must vacate the property before 10:00 o'clock or agreed on otherwise on the departure day. The owner will provide a set of keys on the arrival day for the use of the client and the client will leave the keys inside the property on the departure day.

3 The client must pay a security deposit of € 200,00 to the owner, which will be refunded by a bank transfer to the client’s bank account when the rental period has been fully completed, the terms of the rental have been fully met and the property has been inspected and no damage or breakages have occurred. In the case of any damage or breakages, the amount for any repairs will be deducted from the security deposit, and any further costs will be charged to the client.

4 Prior to the client occupying the property, the agreed rental price must be settled in full. In order to exclusively confirm a booking, a deposit of 30% of the total agreed rental price must be paid straight away. This amount is € 0,00 and can be paid via bank transfer to . . .

5 The cancellation by the client of a reservation up to 5 weeks before the arrival date will incur a charge of 30%. If the cancellation is made 7 days before the arrival date, the charge will be 90%. If the cancellation is made less than 7 days before the arrival date, no refund will be available.

6 The total rent is € 0,00, which corresponds to a weekly rent of € 0,00. After the initial 30% payment is made, the remaining 70% € 0,00 can to be paid via bank transfer 4 weeks before arrival to . . .

7 If the deposit of 30% of the total rental costs is not paid within the agreed terms, the reservation will be considered void.

8 In the event of an Act of God, or any other events beyond the control of the owner which prevents the agreed rented property from being occupied, the owner has the right to change the rented property to another one of the same size with similar features. The owner will, in this case, endeavour to provide the best property of similar quality and closest location possible to the original property. The agreed rental price will not change.

9 The meetingpoint is the roundabout at the tourist information office / oficina de tourismo. See attatched map and document with the phonenumber of Walter (our contact in Estepona). The office, Estepona Services, is in Avenida Luis Braile, Puerto Paraiso, Local 26.

10 When the rental period is for 2 weeks or more, weekly quick clean and linen change is included on request. Please book this on arrival. The final cleaning session takes place after the departure of the client. If the apartment is unusually dirty after the departure of the client, or if there are major cleaning difficulties incurred by the client, a charge will be deducted from the clients deposit for the extra cost. The client pays € 0,00

11 Bed linen, towels and all usual household items required for basic living will be provided by the owner. The towels provided with the property may not be used outside of the property or for uses other than household hygiene.

12 The rental price includes costs for supply of electricity, gas, water as well as all the taxes. Any unusual consumption of electricity will be charged to the client. The client must be responsible for switching off all the lights when leaving the houses and switching off all heaters, air conditioning units and kitchen appliances and accessories when not in use.

13 The property can only be occupied by the agreed people whose full details have been declared to the owner. Any extra person must be authorised by the owner and is only permitted to stay overnight if there is the available bedspace. It is not permitted for anyone to sleep on the sofas, floors or tables.

14 Pets are not allowed.

15 The owner has the right to refuse entry to the house to anyone at any time, and has the right to end the rental agreement at any moment, if there is evidence of the client not using the house properly or using it for purposes other than are appropriate for a holiday rental.

16 The owner is not responsible for any theft or loss of valuables in the property. Clients are advised to keep valuables in a safe if possible and/or to keep valuables with them at all times. This short-term holiday rental contract does not include insurance against theft or loss of personal items and is not linked to any insurance cover the client may have included in their credit card, home insurance or travel insurance. Should a theft or robbery occur, clients are asked to inform the local manager immediately by telephone. Safety deposit boxes are also available at post offices and banks.

17 The houses are insured against fire, storm, water damage from solid pipes or fixed installations, and rainwater coming through the roof. Damage sustained to the property or to belongings of the client must be reported immediately to the manager or the owner.

18 The client has the role of the house owner during his stay. The owner is not responsible for any damages suffered by the client due to a deterioration of any parts of the house during the stay.

19 The owner provides an extra bed / babycod / highchair, the client pays the amount of € 0,00.

The client declares to have read this contract carefully, to have understood it in all its parts and to agree to it entirely. On returning it by email the client is then bound by legal agreement with the owner, according to the terms, conditions and agreements detailed above.
